How do workers’ compensation payments affect my disability benefits?

Workers’ compensation payments will affect your disability benefits, but once again it’s a statewide determination. Some states are direct offset and some states are reverse offset. Depending on the nature of the state that you’re living in, either one the workers’ comp carrier or two, the Social Security Administration will be offsetting your benefits. Now, there’s also an offset provision as to whether or not their temporary disability benefits under workers’ comp or permanent disability under workers’ compensation.

It’s important that you find an attorney in the state that you’re in to represent you and your Social Security disability claim, especially if you have a claim pending in that same state for workers’ compensation. An attorney who does or knows both is in the best position to service the client.
