Railroad Retirement Act

Railroad occupations are inherently dangerous and tend to have a higher incident of injury and illness than other types of jobs. For this reason, the Railroad Retirement Act includes crucial provisions that entitle railroad industry workers to disability payments for total and occupational disabilities. The 1934 legislation and its amendments provide for similar programs as the Social Security Act. However, the Railroad Retirement Act differs in key ways, including its benefits structure.

RRB Total Disability

RRB total disability is available to you at any age if you sustain a permanent, total disability and have worked in the railroad industry for at least 10 years, or in certain circumstances, five years.

The definition of total disability is the same under the RRB and Social Security programs. Total disability is a physical or mental impairment that prevents you from engaging in regular, gainful employment and has lasted or is expected to last at least 12 months or result in death.

In addition to disability benefits, you may qualify for early Medicare before you reach age 65 if you have a total disability or you have chronic kidney disease.

RRB Occupational Disability

Occupational disability benefits may be available if you have a physical or mental impairment that prevents you from performing duties related to your regular railroad occupation, even if you are able to perform other types of jobs. You are eligible at any age if you have at least 20 years of employment and remain in a railroad industry job. You may also apply for benefits if you are between 60 years old and full retirement age and have at least 10 years of railroad industry employment.
