CLAIMANT’S FAILURE TO REPORT SIDE EFFECTS

I have been asked if a claimant’s failure to report side effects are a valid basis for finding that the claimant is not credible.   Often, the time spent between the patient and medical provider is short and there is very little time to convey or record some of the problems with side effects of medication. As a society who have come to expect them. So, if the side effects are something one must live with, then what is the point of complaining about the. Many realize that complaints serve no purpose. As a consequence of this reality, there is case law out there that says that ‘a failure to report side effects is not a valid basis for discounting a plaintiff’s credibility.” Terry v. Astrue, 580 F3d 471 (7th Cir. 2009)
