What Does the Social Security Administration Consider a Disability?

The SSA defines disability in its rules. The definition may differ from that of your doctor, another government program or your insurance company.

You must meet the following elements of the definition to qualify for benefits:

  • You can no longer perform your previous job
  • Your medical condition prevents you from performing other types of jobs
  • Your disability has lasted or is expected to last for at least one year or to result in death

Determining the Severity of a Medical Condition

When reviewing your application, the SSA considers the answers to a series of questions to determine if you are disabled. These questions include:

  1. Are you currently working at a job that earns you less than the minimum statutory monthly wages?
  2. Does your medical condition interfere with your job-related duties, rendering you unable to work?
  3. Is your medical condition included on the SSA’s List of Impairments?
  4. If your medical condition does not appear on the List of Impairments, does it interfere with your ability to perform the job you did before?
  5. Are you able to engage in other gainful employment, when the severity of your medical condition, age, education, employment history and job skills are taken into account?

Social Security Listing of Impairments

The Listing of Impairments includes medical conditions so severe that gainful employment is not possible for an adult who suffers from the medical condition. The applicant must only demonstrate that the medical condition is expected to last continuously for at least 12 months or to result in death to qualify for Social Security disability benefits.

The list is divided into two parts: adult listings (Part A) and childhood listings (Part B). Part A and B are each further categorized into major body systems. Each body system category lists descriptions of various severe injuries and illnesses that the SSA presumes are disabilities.

Convenient Pasco County Location

Our office is located on U.S. Highway 19, just three miles south of the Hernando-Pasco County line, in the Viva Villas Shopping Plaza. This office serves clients who come from Bayonet Point, Aripeka, Shady Hills, Timber Pines, High Point, Pine Island, Hernando Beach, Weeki Wachee and other towns along the the U.S. 19 corridor through Homosassa and into Citrus County and Crystal River. Our Sugarmill Woods clients also find this office their most convenient location.

Pasco, Hernando and Citrus Counties do no have a court in which to hear Office of Disability Adjudication and Review (ODAR) cases, so yours will be handled in a court outside of your county.
